Terms

What this is
The Regimen is software for gyms: coaches write the programming, members log their scores, and everyone can see the board. These are the terms you agree to by using it. They are written to be read, not to be impressive.
Your account
You need an account, and it is yours alone — do not share your sign-in with anyone else. Keep your password to yourself, and tell us if you think somebody else has it. You must be 13 or older to have an account.
You can delete your account at any time from the Profile screen, and we can suspend or remove an account that is being used to harass people, break the law, or attack the service.
Gyms, coaches and your data
When you join a gym, its coaches, admins and owners can see your results and attendance at that gym, can log results and check-ins on your behalf, and keep a private coaching file about you, which can include injuries and limitations. Other members of the gym can see your results, your athlete card and what you post. Joining is how you consent to that. If you would rather they could not, leave the gym or delete your account.
A gym’s owner controls the gym: its tracks and who sees them, its programming, its members and its roles. We do not arbitrate disputes between a member and their gym, and we will not remove a gym’s own programming or attendance records on a member’s request. What we will always do is let you delete your own account and the personal data in it.
The privacy policy sets out what we store and who sees it, and it is part of these terms.
If you coach or run a gym
Coaches, admins and owners can see things about members that members cannot see about each other, and you are responsible for how you and your staff use them. Record only what you need to coach someone, keep it accurate, and correct or remove it when a member asks. Use member information only to run your gym. Give a coach, admin or owner role only to people you trust with members’ coaching files, because the role opens them.
Only send email invites to people who would expect to hear from your gym. You are responsible for what you post as a gym, including announcements.
What you post
Comments, messages in your gym’s chats (the gym chat, groups and one-to-ones), notes on your scores, photos and announcements are seen by other people at your gym, so keep them decent: nothing unlawful, harassing or hateful, and nobody else’s private information. Your gym’s owners and admins can read every chat at the gym, groups and one-to-ones included. Only upload a photo you have the right to use. A comment can be removed by the person who wrote it, the person whose score it is under, or a gym admin; a chat message by the person who wrote it or a gym admin, who can also pause someone from writing in the chat for a while. We can remove anything that breaks these terms.
Anyone can report a comment, under a score or under a workout, or a message in a chat, from its menu. It is hidden for them straight away, and the gym’s owners and admins review it and decide whether it stays. Gym owners agree to review reports promptly. Anyone can also block another member, which hides that person’s comments and chat messages from them and stops that person commenting on their scores.
There is no tolerance for objectionable content or abusive users. A filter refuses some words outright. We look at every report within 24 hours, remove anything that breaks these terms, and remove the account of anyone who posts it.
Who owns what
Your results and your notes are yours. The workouts and programming a gym writes belong to that gym. The app itself — its code, its design, its name — belongs to us. Benchmark workouts in the standard library are long-standing community property and are included for reference; naming one does not imply any affiliation with or endorsement by CrossFit, Inc. or anyone else, and The Regimen is not affiliated with CrossFit, Inc.
By logging a result you let us store and display it to the people described in the privacy policy, which is simply what makes the leaderboard work. We claim nothing else over it.
This is not medical or coaching advice
The Regimen displays what your coaches programmed. It does not check whether a workout is safe or appropriate for you, and neither its percentage calculators nor its scaling suggestions are medical advice. An injury in a coaching file is a coach’s note, not a diagnosis. Lifting heavy things carries risk. Talk to your coach and, where it matters, to a doctor. You train at your own risk.
What we promise, and what we don’t
We work hard on this and we want it to be good, but the service is provided as-is. We do not promise it will never be down, never lose anything, or never be wrong. We keep backups; you should not treat The Regimen as the only copy of anything you cannot bear to lose.
To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to what you paid us in the twelve months before the claim. Nothing here limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud.
Paid plans
Gym plans are billed to the gym, not to its members; being a member of a gym on The Regimen costs you nothing.
A gym’s owner subscribes on the web, for $99 a month plus any tax that applies, billed monthly in advance by our payment processor, Stripe. A new gym’s first 7 days are free: the card is taken when the trial starts and first charged when it ends, and we email the owner 3 days before. The owner can cancel any time from Billing in the gym’s settings; the gym stays open to the end of the period already paid for, and we do not refund part months.
If a payment fails, the gym stays open for 7 days while it is put right. After that it is read-only until it is paid: everyone can still sign in and see everything, but nothing new can be posted, logged or booked. The same applies once a subscription has ended. Nothing is deleted because a payment is late.
We will give the owner at least 30 days’ notice by email before changing the price. We may pause or close a gym that breaks these terms.
Changes, and the legal bits
We may update these terms. If a change matters, we will tell you in the app before it takes effect; carrying on using the app after that is how you accept it. If you do not accept it, delete your account.
These terms are governed by the laws of Texas, and any dispute goes to the courts of Texas. If any part of this is unenforceable, the rest still stands.
